6. PCI-DSS Statement

TimeWorks POS software integrates with PCI-DSS compliant payment gateway providers for the processing of credit and debit card transactions. Card payment data is processed directly by these certified third-party payment providers and is not stored, transmitted, or processed on TimeWorks systems or infrastructure.

TimeWorks does not store card numbers, CVV codes, or cardholder data. Our role in the payment process is limited to initiating the payment request to the certified gateway. Each payment gateway partner maintains its own PCI-DSS certification, which can be verified with the respective provider.

While TimeWorks implements security best practices for its own systems, the PCI-DSS certification status of payment processing is held by the relevant gateway provider. Merchants using TimeWorks POS may need to conduct their own PCI-DSS self-assessment questionnaire (SAQ) depending on their specific payment environment. Please consult a qualified security assessor (QSA) if you are uncertain about your obligations.

7. Load Shedding and Power Interruption Statement

TimeWorks POS software is designed with offline capability, allowing continued processing of sales transactions during periods when internet connectivity or cloud services are unavailable due to load shedding or other power interruptions. Offline transactions are synchronised to the central system when connectivity is restored.

However, TimeWorks cannot guarantee uninterrupted system operation during extended power outages that exceed the capacity of installed UPS (uninterruptible power supply) units or backup power systems. The duration of UPS backup power varies by installation and is not within TimeWorks's control.

TimeWorks recommends:

• Installing an adequately sized UPS on all POS hardware and networking equipment.
• Considering a generator or solar backup solution for extended load shedding protection.
• Contacting TimeWorks to assess UPS requirements for your specific installation.

Downtime caused by load shedding beyond installed UPS capacity is classified as a force majeure event and is excluded from TimeWorks's service level commitments. See our Terms and Conditions for the force majeure clause.

8. Limitation of Liability

To the maximum extent permitted by applicable South African law, TimeWorks's total aggregate liability for any claims arising from the use of this website or reliance on information contained on this website is limited to the total fees paid by you to TimeWorks in the twelve (12) months immediately preceding the event giving rise to the claim.

In no event will TimeWorks be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use this website or any information obtained from it, including but not limited to loss of revenue, loss of profit, loss of data, or business interruption, even if TimeWorks has been advised of the possibility of such damages.

Nothing in this disclaimer limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable South African law, including liability under the Consumer Protection Act 68 of 2008.

9. Indemnification

You agree to indemnify and hold harmless TimeWorks Data Solutions, its directors, officers, employees, agents, and contractors from and against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your use of this website, your reliance on any information contained on this website, or your violation of these disclaimers or any applicable law.
