Hardware Sales Terms

Terms governing the purchase of POS hardware, peripherals, and related equipment from TimeWorks Data Solutions.

These Hardware Sales Terms apply to all purchases of POS hardware and peripherals from TimeWorks Data Solutions (Pty) Ltd ("TimeWorks"). They must be read together with our General Terms and Conditions.

1. Product Descriptions and Specifications

TimeWorks makes reasonable efforts to accurately describe all hardware products, including technical specifications, dimensions, compatibility information, and images. However, manufacturer specifications are subject to change and minor variations may occur.

Where a product is described as refurbished or pre-owned, this will be clearly stated in the product listing and on your quote. Unless explicitly stated, all products supplied are new.

If a specific configuration or custom build is ordered, the accepted quote or order confirmation document constitutes the definitive specification for that order.

2. Pricing and Payment

All prices quoted by TimeWorks are in South African Rand (ZAR) and are inclusive of VAT at the prevailing rate, unless otherwise stated on your quote.

Written quotes are valid for 30 calendar days from the date of issue. TimeWorks reserves the right to revise pricing after quote expiry due to supplier price changes, exchange rate fluctuations, or changes in VAT.

Accepted payment methods include:

  • Electronic funds transfer (EFT) - our preferred method.
  • Credit or debit card via our secure online payment gateway.
  • Cash - for in-person transactions only (FICA limits apply).

Full payment is required before goods are dispatched or installation is scheduled, unless a separate credit agreement has been signed.

3. Ordering Process

The standard ordering process for hardware purchases is as follows:

  1. Quote - You request a quote via our website, by phone, or by email.
  2. Acceptance - You sign or electronically accept the quote and provide any required information.
  3. Payment - You make full payment (or an agreed deposit where applicable).
  4. Order Confirmation - TimeWorks issues a written order confirmation and estimated delivery or collection date.
  5. Delivery or Collection - Hardware is delivered or made available for collection as agreed.

An order is only confirmed and binding once TimeWorks has issued a written order confirmation. Quote acceptance alone does not constitute a binding order.

4. Delivery

TimeWorks delivers hardware within the Cape Town metropolitan area. Delivery to other locations in the Western Cape or elsewhere in South Africa may be arranged at additional cost - please enquire when requesting your quote.

Estimated delivery timeframes are provided on your order confirmation. While TimeWorks makes every reasonable effort to meet these timeframes, they are estimates only and are not guaranteed. Delays caused by supplier lead times or force majeure events do not constitute a breach of contract.

Risk of loss or damage passes to you at the point of delivery. You or your authorised representative must be present to receive and sign for delivery. If delivery cannot be completed, a re-delivery fee may apply.

Please inspect all goods at the time of delivery. Any visible damage or missing items must be noted on the delivery documentation and reported to us within 48 hours.

5. Installation

Installation services are available and may be included in your package or quoted separately. Where installation is not included in your purchase, hardware is supplied for self-installation or installation by your nominated technician.

TimeWorks installation technicians will configure hardware to work with your TimeWorks POS software. Installation of third-party systems or non-standard environments may require a separate assessment and quote.

You are responsible for ensuring that the installation site meets minimum technical requirements (power, networking, space) prior to the installation appointment. Aborted appointments due to an unprepared site may result in a call-out fee.

6. Statutory Warranty - Consumer Protection Act

In accordance with Section 56 of the Consumer Protection Act 68 of 2008 (CPA), all hardware supplied by TimeWorks carries a statutory implied warranty of six (6) months from the date of delivery. This warranty covers defects in materials and workmanship under normal use conditions.

If a product is found to be defective within this period, you have the right to choose from the following remedies:

  • Repair - TimeWorks will repair the product at no cost to you.
  • Replacement - TimeWorks will replace the product with an equivalent new or refurbished unit.
  • Refund - TimeWorks will refund the purchase price of the defective product.

The choice of remedy is yours as the consumer. We will honour your selection within a reasonable timeframe. This statutory warranty applies to consumers as defined in the CPA and cannot be excluded or limited.

7. Extended Warranty Options

TimeWorks offers optional extended warranty and hardware maintenance agreements beyond the six-month CPA statutory period. These cover parts and labour for an agreed period and are quoted separately.

Extended warranty terms are set out in your specific maintenance agreement document. Please speak to our sales team for available options on the hardware you are purchasing.

8. Warranty Exclusions

The following are excluded from all warranties (statutory and extended) unless otherwise agreed in writing:

  • Physical damage caused by misuse, dropping, liquid ingress, or accident.
  • Damage caused by power surges, lightning strikes, or unstable power supply - including damage occurring during load shedding events or generator switching.
  • Damage caused by installation by an unauthorised person or modification of the hardware not approved by TimeWorks.
  • Consumable items including thermal paper rolls, receipt paper, ink ribbons, and label stock.
  • Cosmetic damage that does not affect functionality, including scratches and minor scuffs from normal use.
  • Software issues or conflicts on hardware not supplied by TimeWorks.

We strongly recommend fitting all POS hardware with a suitable UPS (uninterruptible power supply) to protect against power surges. TimeWorks can supply and install UPS units - enquire when placing your order.

9. Returns for Change of Mind

If you wish to return hardware for reasons other than a defect, TimeWorks will accept returns within 7 calendar days of delivery, subject to the following conditions:

  • The product must be in its original, unopened packaging.
  • All accessories, cables, power adapters, documentation, and original packaging must be included.
  • The product must be undamaged and unmodified.
  • A return authorisation number (RMA) must be obtained from our support team before returning goods.

Change-of-mind returns for custom-configured hardware, software-activated systems, or products specially ordered for you may not be accepted. A restocking fee may apply. See our Refund and Returns Policy for full details.

10. Title and Ownership

Ownership and title to hardware purchased outright passes to you only upon receipt of full payment of all amounts owing on your order. Until full payment is received, the hardware remains the property of TimeWorks.

Where hardware has been delivered before full payment is received (for example, under a phased payment arrangement), TimeWorks retains a security interest in the hardware until all outstanding amounts are settled in full.
